A Joint Report or Joint Scott Schedule is typically required where both the Applicant and Respondent have obtained independent expert witness reports.
The term “joint” refers to the requirement for the experts to confer and prepare a single document that clearly sets out the areas in which they agree and disagree.
This document is intended to provide an easy-to-follow summary for the Tribunal Member and the parties, dealing with the alleged defects and the associated costs or loss.
In many instances, the experts may agree that a defect exists, but disagree on the appropriate rectification methodology. In other cases, they may agree on the methodology, but differ on quantities, rates, or the overall cost of labour and materials. There are many variables involved; however, the process assists the Tribunal in obtaining a clear and structured understanding of the issues in dispute.
The joint process also provides an opportunity for experts to reconsider their positions and, where appropriate, reach agreement or a middle ground.
Typically, the experts will meet, either on site or at an agreed location, and review the report item by item. The objective is to discuss each issue in a professional and cooperative manner, and to resolve matters where possible using a practical and efficient approach.
